In response to a parliamentary question, on 16 February 2026, the Norwegian Minister of Justice and Public Security stated that the EU anti-SLAPP Directive falls outside the scope of the Agreement on the European Economic Area (EEA Agreement) and there has therefore not been a formal process to assess its relevance for Norway. The Minister recognised that Recommendation CM/Rec(2024)2 of the Committee of Ministers of the Council of Europe on countering the use of SLAPPs does affect Norway.
The Minister considers that Norwegian legislation already has sound and flexible mechanisms to counter SLAPPs, and notes she is not aware of the Norwegian legal system being abused in this way.
It does therefore not appear that any implementing legislation is currently planned in Norway.
